Terms of Service — Harakumo

1. Agreement

By creating an account or using Harakumo ("the Service"), you agree to these Terms of Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. The Service

Harakumo provides cloud infrastructure services including hosting and deploys, edge functions, file storage, databases, domain registration and management, email delivery, sign-in and payment tools for your own users, AI model access, and related developer tooling. Services are provided on an "as available" basis during the public beta; features may change or be discontinued with notice.

3. Accounts and organizations

You are responsible for safeguarding your credentials and API keys.
Resources belong to organizations; organization owners control member access and roles.
You must provide accurate account information and be at least 16 years old.

4. Acceptable use

You agree not to use the Service to:

violate any law, infringe intellectual property, or distribute malware;
send spam or unsolicited bulk communications;
attempt to gain unauthorized access to other tenants' data or the platform itself;
run workloads that intentionally degrade the Service for other customers.

5. Your content

You retain all rights to code, data, and content you deploy. You grant Harakumo only the rights needed to operate the Service — storing, executing, and serving your content at your direction. We do not use your content to train models or for advertising.

6. Billing

Prices are in US dollars and do not include taxes such as sales tax, VAT or GST. Where a tax applies to what you buy, you are responsible for it.
Plans are billed monthly in advance and priced per subscription. One subscription can cover several of its owner's workspaces (Pro 3, Team 10 and Scale 25), which share its limits. An upgrade takes effect at once and is charged the prorated difference. A move to a cheaper paid plan takes effect at the next renewal. You can cancel at any time; paid features remain active until the end of the billing period.
Usage beyond what a plan includes, such as additional AI usage and domain purchases, renewals and transfers, is paid from a prepaid workspace balance. Top-ups are paid in advance, do not expire and are not refundable. A remaining balance is forfeited when the workspace is deleted, and only after you confirm that. For a subscription that covers several workspaces, AI usage and usage beyond the plan in each of them are paid from the balance of the workspace that pays for the subscription.
Domain prices are shown before each purchase or renewal. You can set an optional monthly spending limit on usage paid from the balance.
A saved card is charged only for your plan, for top-ups or purchases you choose to pay by card, and for auto-reload or auto-renew when you turn them on.
Harakumo Payments charges sellers 3.9% + 30¢ per successful charge. A seller's earnings from each payment are held for 7 days before they can be withdrawn.
Fees are non-refundable except where required by law.

7. Domains bought through Harakumo

Domains you buy through Harakumo, and domains you transfer in, are registered through Harakumo's own account with our domain registrar. Harakumo is the registrant of record: the domain's registration lists Harakumo as its holder, with Harakumo's contact details, not you. Your name and contact details are not sent to the registrar.
Your workspace is the record that the domain is yours. From the dashboard or the API you control its DNS, which project it serves, its renewal and its transfer, and we act on those instructions.
Registration is also subject to the rules of the registry that runs the domain ending and, where they apply, ICANN's policies, including its dispute-resolution policies.
You can move a domain to another registrar whenever you like, except in the first 60 days after it was registered or transferred, when registries lock it. Ask from the dashboard or the API; we unlock the domain and give you its transfer code within five calendar days, by email and in the dashboard. The domain keeps working here until it has moved, and at the new registrar you can register it in your own name.
A domain that is not renewed expires and can be lost. A workspace that still holds a domain bought through Harakumo cannot be deleted until the domain has been transferred out or has lapsed.

8. Deletion, suspension and termination

You can delete a project, a workspace or your account at any time. Deletion takes effect at once and cannot be undone: the sites, apps, functions, databases, stored files and other resources in it are removed straight away, with no grace period in which to recover them. Download anything you want to keep before you delete it. A database can be downloaded as a .sql file, stored files from their bucket, and repository files through the API.
Deletion is refused while money or domains are unsettled, for example while a project holds earnings not yet withdrawn or a workspace holds a domain bought through us. The refusal says what to do first.
We may suspend or close accounts and workspaces that violate these terms, with notice where practicable. Suspending a workspace deletes nothing. While it is suspended its sites, apps and functions stop serving, its API keys stop working, and deploys, mail, purchases and changes are refused. Its members can still sign in, see what it holds, download stored files, pay, manage the team and delete things. If you need other data out of a suspended workspace, contact us.
We keep the records we are required to keep, such as payment, refund and balance history, after an account or workspace is deleted.

9. Disclaimers and liability

The Service is provided without warranties of any kind. To the maximum extent permitted by law, Harakumo's aggregate liability is limited to the amounts you paid in the twelve months preceding the claim. Nothing in these terms limits liability that cannot be limited by law.

10. Changes

We may update these terms; material changes will be announced by email or in the dashboard at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
